An Irish man has cried out after his Ugandan Fiancee claimed his house, 10 plots of land and a farm worth billions of shillings he registered in her name.
According to DailyMonitor, an Irish national, David Michael O’Connel, has cried out after the Mpigi Magistrate Court in Uganda ordered him out of the house, ten plots of land, and a farm worth billions of shillings, after he bought the properties in the name of his Ugandan fiancée but was unable to prove that he was the financier.
Chief Magistrate Ruth Nabaasa said in her ruling on Friday, September 10, that the court would not get into the nitty gritty of whether Mr O’Connel sponsored Ms Catherine Nakawooza’s acquisition of 10 plots of land, 10 acres of farm land, and a mansion worth billions in Namayumba, Wakiso District.
Chief Magistrate Nabaasa said,“merely financing a land transaction in which another individual is registered as the proprietor is not one of the legally recognized exceptions to indefeasibility of title under the Registration of Titles Act,”.
“It seems moot and academic for this court to venture into analysing whether indeed it is the respondent’s funds (Mr O’Connel) that paid for the petitioners’ lands (Ms Nakawooza). I am aware that the petitioner (Ms Nakawooza) contested the nexus between the documentary evidence adduced by the respondent to prove that he was the source of funds for the petitioner’s land transactions,” she further added
“Nonetheless, owing to my findings in issue 2, I am satisfied that the residential home of the petitioner (Ms Nakawooza) where she ordinarily resides with her three issues, rightful belongs to her. An order doth issue restraining the respondent (Mr O’Connel) from accessing this home without the petitioner’s prior permission,” Ms Nabaasa ruled.
Mr Godfrey Rwalinda represented Ms Nakawooza, while Mr Mohammad Mbabazi represented Mr O’Connel . According to court filings, Mr. O’Connel and Ms. Nakawooza began dating in 2002.The couple began dating around the same time and went on to have three children together.
According to court records, Ms Nakawooza presented proof that she married Mr O’Connel in a traditional ceremony on January 25, 2014 in Bweyogerere, near Kampala. As seen on lindaikeji page on Instagram.
