LG AUTONOMY: Senate Demands Compliance with S'Court Ruling on LG Funds

In a decisive move on Wednesday, the Nigerian Senate called on state and local governments to immediately adhere to a Supreme Court ruling concerning local government accounts and the direct allocation of funds to them. This landmark decision underscores a growing determination to ensure financial autonomy for local governments across the nation.


The resolution was announced by Deputy Senate President Jibrin Barau following a closed-door session where lawmakers debated attempts by certain state governments to circumvent the Supreme Court's ruling issued on July 11. This ruling, which declared that it is unconstitutional for state governors to retain funds designated for local government administrations, has sparked significant debate and concern among lawmakers.


Senator Tony Nwoye led the charge, emphasizing the urgent need to halt state governments from enacting laws through their Houses of Assembly that undermine the Supreme Court's decision. Nwoye's motion, co-sponsored by 12 other senators, highlighted allegations that some state governments were attempting to sidestep the ruling by passing counterproductive legislation.


The motion expressed deep concern over the tactics employed by these state governments, which have reportedly included inserting clauses into local laws that mandate local councils to remit a substantial portion of their allocations to state-controlled accounts. Such accounts are often described with various terms, such as "State/LGA Joint Account" or "Local Government Joint Security Trust Account," effectively allowing governors to retain control over funds intended for local governance.


Senator Nwoye accused certain governors of exploiting their legislative powers to enact laws that compel local councils to funnel money into these joint accounts, a practice that directly contradicts the Supreme Court's ruling. The July decision not only prohibited governors from withholding funds but also barred them from dissolving democratically elected local government councils, reinforcing the integrity of local governance as stipulated in the 1999 Constitution.


The Senate’s commitment to alter constitutional provisions to ensure full autonomy for local government administration marks a critical step toward empowering local governance. By pushing for changes that support financial independence, the Senate aims to eliminate the obstacles that have historically hampered the effectiveness of local governments.


As the debate continues, the resolution underscores a growing frustration among lawmakers regarding the erosion of local governance by state authorities. The Senate's actions signal a clear message: compliance with the Supreme Court ruling is not optional, and efforts to undermine local government autonomy will not be tolerated.


With the stage set for potential constitutional amendments, the Senate's determination to uphold the principles of democracy and decentralization in Nigeria has never been more crucial. The path forward will require vigilance and a unified effort to ensure that local governments can operate independently and effectively, fulfilling their mandates to serve the communities they represent.
