Judge's Absence Stalls Suit Against Fed Poly Nekede Rector



The suit challenging the emergence of renowned academic Dr. Basilia Igbokwe as the Rector of Federal Polytechnic Nekede Owerri Imo State could not be heard at the National Industrial Court of Nigeria, NICN, Abuja Division on Friday September 20, 2024 owing to the absence of the trial judge.


The judge, Justice E. D Isele was reported to be indisposed hence could not sit over the matter filed by a rights group Kingdom Human Rights Foundation International.


The development stalled the efforts of Dr Igbokwe and the institution at seeking the vacation of the interim order stopping her oath of office on Tuesday, September 17, 2024.

The Court had while ruling on a motion ex parte on Friday September 13, 2024 given an interim order stopping the oath of office of Dr Igbokwe till the hearing of the motion on notice or final determination of the substantive suit.


However the court would sit on Monday to hear the matter.


Counsel to the petitioner, Barrister Kingdom Okere said what it means is that the status quo remains.


By this, he explained that Dr. Igbokwe cannot be administered with oath of office or act as rector of the polytechnic.


Barr. Okere added that Dr. Igbokwe risks spending time in the gaol if she disobeys the court.


He disclosed that Dr. Igbokwe and the Polytechnic on Thursday September 19, 2024 filed a motion which the petitioner is entitled to respond to on Monday.


In the motion, Hon Henry Ikoh, Chairman, Governing Council is urging the court to vacate the interim order as it has grounded activities at the institution.


He argued that the petitioner has nothing to lose should the order subsists even as he assured that the polytechnic was ready to see to the logical conclusion of the matter.


Recall that Dr. Basilia came tops in a screening exercise carried out by the Rector Selection Board headed by a former Rector of Abia State Polytechnic Aba Professor Okorie Kalu Osonwa.


Later, six other academics she floored wrote a petition to the Minister of Education alleging a breach of the Federal Polytechnics Act in the selection of rector. It was gathered that the six lecturers were against the administration of a written examination rather than oral interview during the screening exercise.
