Tax Reform Bills: Senate Bows to Pressure

The Senate has decided to halt proceedings on the contentious tax reform bills that have sparked widespread debate and public unrest.


In a move aimed at addressing mounting concerns, the Senate instructed the Committee on Finance to suspend its ongoing public hearings on the bills until further consultations can be held.


The decision, announced by Deputy Senate President Jibrin Barau during a plenary session on Wednesday, December 4, 2024, comes after significant opposition from various political leaders and regional groups. In response to the unrest, the Senate has also set up a special committee to engage with the executive branch of government, working together to resolve the disputes surrounding the proposed legislation.


The tax reform package includes several key bills: the Joint Revenue Board of Nigeria (Establishment) Bill, 2024; the Nigeria Revenue Service (Establishment) Bill, 2024; and the Nigeria Tax Bill, 2024.


Since their introduction, the bills have faced intense scrutiny, particularly from Northern governors, who have labeled them as “anti-democratic” and unfair to their regions. In light of this opposition, the National Economic Council (NEC) has called for the bills to be withdrawn for further review and consultation.


Senator Shehu Buba (APC, Bauchi South) commented on the growing discontent, suggesting that Northern Senators were in favor of pulling the bills back for a more thorough examination. He highlighted concerns over the bills' complexity and the potential negative impact of the proposed VAT derivation formula on Northern states, which could face disproportionate losses.


The situation escalated on Tuesday, when President directed the Ministry of Justice to engage with the judiciary to help clarify legal ambiguities surrounding the reform proposals. This was seen as a critical step toward resolving the issues and bringing the parties closer to a consensus.


In his address, Deputy Senate President Barau emphasized the Senate’s role as a stabilizing force in Nigerian governance. He stated that the Senate would prioritize national unity over political, ethnic, and regional differences in resolving the issues related to the tax reform bills. 


“The Senate is composed of individuals with wisdom and experience, entrusted with the responsibility of legislating for the peace, stability, and development of our country,” Barau remarked. “In times of disagreement, we remain committed to dialogue and consensus-building, as we have done since 1999.”


Barau also acknowledged the broader context in which these tax reform discussions are unfolding, noting that Nigeria faces significant economic and security challenges. He reaffirmed the Senate’s commitment to supporting the President's efforts to address these issues, while ensuring that the tax reforms do not exacerbate the country’s current difficulties.


“The President and the Senate have agreed to work closely with the Executive and the Judiciary to resolve these matters,” Barau added. “We will engage the Attorney General of the Federation to help identify and address the contentious areas of the reform proposals.”


As part of this effort, the Senate Committee on Finance has been instructed to suspend further actions on the bills, including public hearings and other related activities, until the underlying issues are fully addressed. 


A special committee, composed of Senate leadership and key members, will meet with the Attorney General on Thursday, December 5, 2024, to discuss and work towards resolving the outstanding disputes. Members of the committee include prominent senators such as Adamu Ailero (PDP, Kebbi Central), Orji Kalu (APC, Abia North), Seriake Dickson (PDP, Bayelsa West), and others.


As the Senate seeks to balance the need for fiscal reform with the concerns of diverse political and regional stakeholders, consultations continues.
