Simon Atigwe, who represents the Igboeze North/Udenu federal constituency, has been sacked by the House of Representatives tribunal.
Dennis Adjmi Agbo, of the Labour Party, has been declared the winner of the Igbo Eze North/Udenu Federal constituency rerun election by the tribunal.
The Independent National Electoral Commission (INEC) declared Atigwe, of the Peoples Democratic Party (PDP), winner of the re-run election held on February 3rd, 2024.
The PDP candidate won with 23863 votes, defeating Agbo with 23226 votes, as announced by INEC.
Agbo, who was previously declared winner of the February 25th, 2023 election but subsequently fired by the appeal court, proceeded to the tribunal to challenge Atigwe’s declaration.
The rerun election was characterized by incorrect results computation and substantial non-compliance with the electoral act, among other things, as argued by his lawyers.
On wednesday, August 14th, the Tribunal headed by Justice H. N. Kunaza issued a ruling declaring Dennis Nnamdi Agbo to have won the Igbo Eze North/Udenu Federal constituency.
Justice Kunaza’s panel declared invalid, null and void the 2000 votes added to the PDP candidate and restored the votes of 25th February 2023 of 14229 for the PDP and 28870 for the LP candidate Rt. Hon Dennis Agbo.
According to the court, Atigwe was not elected due to the invalid votes cast, as the petitioner won with 23,211, and PDP 21,863 votes. The certificate of return issued to Atigwe should then be withdrawn and issued to Agbo.
